Terms of Service
These terms are the agreement between you and My Card Wizard. They cover what the service does, what it does not promise, and what each of us owes the other.

1 Acceptance and eligibility
My Card Wizard identifies trading cards from scans, estimates what they are worth from market data, and helps you list them on marketplaces you connect. These terms apply to www.mycardwizard.com and to the My Card Wizard app.
By creating an account or using the service, you agree to these terms. If you do not agree to them, do not use the service.
You must be 18 or older to create an account, and you confirm your age when you sign up. The marketplaces this app lists to require their sellers to be 18.
If you use the service for a business, you confirm that you are authorised to accept these terms for that business.
2 Your account
You need an account to use the service. You are responsible for keeping it secure and for everything done under it.
Two-factor authentication is available in Security settings. Turn it on if you connect a marketplace account.
Tell us promptly if you believe someone has used your account without your permission.
One person or business per account. Do not share your sign-in, because an account can create listings on the marketplaces it is connected to.
We send account and security email, such as sign-in codes and a notice when something on the account changes. We may also send a welcome email and occasional product email, and every one of those carries an unsubscribe link.
3 What the service does, and what it does not promise
Card identification is automatic. The name, year, set, card number and grading status are read from your scan by machine-learning services, and the reading can be wrong. For a card game card the finish is not read from the scan: it comes from the printings our catalog holds for that card, and you can change it on the card. Foil and reflective cards are the hardest to read, and a wrong finish can be the difference between a common card and a valuable one.
Prices are estimates, not appraisals. A card game card is priced from the TCGplayer market price for that printing, from a catalog we sync each day. A sports card is priced from eBay's current listings with a discount applied, because a listing price runs higher than what a card sells for, and the app labels an estimate built that way. A graded card gets no price from us, and its list price is yours to set. A card whose finish is genuinely open gets no price until you pick one, and open means the catalog prints that card more than one way with nothing to settle which. Where the catalog points to one printing as the default, the card is priced from it and shown as a Draft, and changing the finish prices the card again. Markets move.
The app shows how confident it is and gives you a prefilled eBay search for the same card, so you can check the result yourself.
You are responsible for confirming a card's identity and its price before you list it, sell it, buy it, or make an offer on it. We are not responsible for decisions you make from these estimates, including money lost on a card sold too cheaply or bought too dearly.
4 You are the seller
My Card Wizard does not buy, sell, own, grade, authenticate, or take possession of any card.
When you list a card, you are the seller and the sale is between you and your buyer on that marketplace. Describing the item honestly, setting the price, shipping it, handling returns, paying taxes and fees, and following that marketplace's rules are all yours.
We are not a party to your sales. Nothing in the service is legal, tax, financial, or investment advice, and trading cards are not an investment product.
5 Your content stays yours
Your scans and your inventory data are yours, and you keep every right to them.
You give us permission to store, process and display that content in order to run the service for you. That includes sending a scan to the identification services named in the Privacy Policy, and sending listing details to a marketplace when you choose to list a card. The permission ends when you delete the content or your account.
You confirm that you have the right to upload what you upload.
Photo Rewards are a separate, optional program and are off unless you turn them on. If you turn them on, you give us permission to show a scan we accept from you to other people using My Card Wizard, as the reference picture for that card. The permission is non-exclusive, covers the picture only, and does not cover your prices, your inventory, or your name. You keep every other right to the picture, including the right to use it yourself anywhere.
You can turn the program off at any time. A scan still waiting to be reviewed is withdrawn at once. A scan we have already accepted and paid you for stays in the catalog, because other people rely on it to check their own cards. Ask us and we will remove it, and we will not take back the scans it earned.
Sale prices you record feed an aggregate pricing calculation described in the Privacy Policy. It produces a statistic and discloses nothing about you to another user.
6 Our intellectual property
My Card Wizard belongs to us or to the people who license it to us: the software, the design, the wording, the pricing methods and the card catalogs we assemble.
These terms give you a limited, revocable, non-exclusive, non-transferable right to use the service for your own selling while your account is in good standing, and nothing more.
That right does not include copying, modifying, or redistributing the service, reselling access to it, building a competing dataset by extracting our catalogs or prices, or using our name and branding to suggest a relationship that does not exist.
If you send us ideas or suggestions about the product, we may use them without owing you anything.
7 Connected marketplaces and other third-party services
You can connect an account such as eBay, Shopify, WooCommerce, CardTrader, Mana Pool, or Square, or export a file for Whatnot, TCGplayer, or Square. When you connect an account, you authorise My Card Wizard to act on your behalf for the things you ask it to do, such as creating a listing.
Those services have their own terms, fees and policies, and you remain bound by them. A listing we create for you still has to satisfy that marketplace's rules, and we do not guarantee that it will be accepted or that it will stay up. Some channels make a listing live immediately, CardTrader among them, and others create a draft for you to review there.
The service depends on outside companies for identification, pricing data, hosting and payments. We do not control them, and if one changes, breaks or stops operating, features here can be interrupted.
You can disconnect any connected account at any time inside the app, which removes the stored credentials for it.
8 Plans and payment
There is a free plan. A paid plan shows its price and what it includes before you are charged, and payment is handled by Stripe. We never see your card number.
Paid plans renew automatically for the billing period you chose until you cancel. You can cancel at any time from Billing, using Manage or cancel. It takes the same few clicks as signing up did, with no phone call or email to send. Cancelling stops the next renewal, and you keep access for the rest of the period you have already paid for.
If you are on a yearly plan, we email you before it renews: about 30 days before the renewal date and again about 7 days before. Each notice gives the date, says that the card you saved will be charged, and links to the page where you cancel.
We will not change the price of a plan you are already on without telling you first and giving you a chance to cancel.
Plan limits are enforced. Scans per month, cards per batch, and similar allowances are real limits, and reaching one is the plan working rather than a fault.
Except where the law requires otherwise, or where section 10 says so, payments already made are non-refundable. If something goes wrong on our side, email us and we will put it right.
9 Acceptable use
Do not upload content you do not have the right to upload, or content that is unlawful.
Do not try to reach another user's account or inventory, probe or disrupt the service, scrape it, overload it, get around rate or plan limits, or resell access to it as your own product.
Do not use bots or scripts against the service except through an interface we provide for that purpose, and do not reverse engineer it except where the law gives you that right regardless of this sentence.
Do not use the service to create listings that are fraudulent or deliberately misdescribed, including listing a counterfeit or altered card as genuine. An automated estimate producing a number does not make a listing you know to be wrong honest.
10 Availability, changes and ending your use
My Card Wizard is under active development. Features are added, changed and sometimes removed, and notable changes appear in the Changelog.
We aim to keep the service running but do not promise any particular uptime, and we may take it down for maintenance. We may set or adjust reasonable usage limits to keep it working for everyone.
You can stop using the service at any time. You can delete your account yourself from Security in the app, which deletes your cards, batches, scans, saved settings and marketplace connections and then closes your sign-in. It cannot be undone.
We may suspend or close an account that breaks these terms, that we are required by law to close, or that has been inactive for a long period. We will tell you why, and we will give notice beforehand where that is reasonable.
If we decide to end the service, we will email you at least 30 days before it closes. Your account stays open until that date, so you can export or download your cards. We will refund the unused part of any period you have already paid for.
Sections that should outlast your account do: permissions already exercised, our intellectual property, the disclaimer, the limitation of liability, indemnification, and governing law.
11 Disclaimer of warranties
The service is provided as is and as available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or secure, that an identification will be correct, or that a price shown will match what a card sells for.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
12 Limitation of liability
To the maximum extent permitted by law, My Card Wizard and the people who operate it are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost sales, lost data, or losses arising from a card being misidentified or mispriced, however the claim is framed and even if we were told the loss was possible.
To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow these limits, so they may not fully apply to you.
13 Indemnification
You agree to indemnify and hold harmless My Card Wizard and the people who operate it from claims, losses, and reasonable legal costs arising from content you upload, listings or sales you make, your breach of these terms, or your violation of a marketplace's rules or someone else's rights.
14 Copyright complaints
Trading cards carry artwork, logos, and likenesses owned by other people. Making your own scan of a card you own in order to sell it is ordinarily fine. Using someone else's picture, or listing counterfeit product, is not.
If you own a copyright and believe material on My Card Wizard infringes it, send a notice to support@mycardwizard.com with the subject line Copyright complaint. Include all of the following: your physical or electronic signature; identification of the work you say is infringed; identification of the material you say is infringing, with enough detail for us to find it; your name, email address and telephone number; a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law; and a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for the owner.
We review every notice, and where a complaint is well founded we promptly remove or disable the material.
If your material was removed and you believe that was a mistake, send a counter-notice to the same address with your name, email address and telephone number, identification of the material and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, and your consent to the jurisdiction of the federal court for the district where you live, or for any district in which we may be found if you live outside the United States. We pass a counter-notice to the complainant and restore the material where it is appropriate to do so.
We close the accounts of users who repeatedly infringe.
15 Trademarks and card images
Pokémon, Magic: The Gathering, Yu-Gi-Oh!, One Piece, Lorcana, eBay, Shopify, WooCommerce, CardTrader, Mana Pool, Square, Cardmarket, Walmart, Discord, TCGplayer, Whatnot, PSA, BGS, CGC, SGC and TAG belong to their owners. We use those names only to say which cards the app reads and which services it connects to.
Some pages name other card tools and show their logos, so that you can see which tool a page is about. Those names and logos belong to their owners too, and naming a tool does not mean its maker took part in the page or agrees with it.
My Card Wizard is an independent tool. It is not affiliated with, sponsored by, endorsed by, or licensed by The Pokémon Company, Nintendo, Creatures, GAME FREAK, Wizards of the Coast, Konami, Bandai, Disney, eBay, Shopify, Automattic, CardTrader, Mana Pool, Block, Cardmarket, Walmart, Discord, TCGplayer, Whatnot, PSA, BGS, CGC, SGC, TAG, or any of the card tools we name.
Card artwork shown beside your scan is a reference picture, loaded from the card databases the Privacy Policy names, so you can check that the app read the right card. Our marketing pages also show cards we own and catalog pictures from those same databases.
The artwork belongs to the card's publisher. We claim no right in it, and it is shown to identify a card rather than to sell one. If you own a right in one of those pictures and would rather we did not show it, use the process in section 14.
16 Changes to these terms
We may update these terms as the service changes. When a change is material we will make a reasonable effort to tell users rather than editing the page quietly.
Continuing to use the service after a change means you accept the updated terms. If you do not accept them, stop using the service and delete your account. The date at the top shows the current version.
17 Governing law and disputes
My Card Wizard is operated from Massachusetts. These terms are governed by United States federal law and the law of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, and the state and federal courts sitting in Massachusetts have jurisdiction.
If you are a consumer in a place whose law gives you rights you cannot sign away, nothing here takes those rights from you, and you keep the right to bring a claim where you live.
Please email us first. Most disputes are a bug, a misunderstanding or a charge that should not have happened, and they are resolved faster in a reply than in a filing.
Either of us may bring a claim in small claims court, or ask a court for an injunction to stop misuse of an account or of intellectual property.
These terms contain no arbitration clause and no class-action waiver.
18 General
These terms, with the Privacy Policy and the Cookie Policy, are the entire agreement between you and us about the service and replace any earlier one.
If a court finds part of these terms unenforceable, that part is limited or removed to the smallest extent needed and the rest stays in force.
A right either of us does not exercise straight away is not given up, and waiving one breach does not waive another.
You may not assign these terms without our written consent. We may assign them to a successor in a merger, an acquisition or a sale of the business, and we will tell you if that happens.
These terms create no rights for anyone who is not a party to them.
We give you notice by email to the address on your account, or by a notice inside the app. You give us notice by email to support@mycardwizard.com.
Neither of us is liable for a failure to perform caused by something outside our reasonable control, such as an outage at a service provider or a network failure.
